I think the Bigg tweaks fix is to not make it a game ending thing, usless you are soloing or everyone gets imprisoned,
 thus allowing another party member to cast freedom after the battle.

Exactly.  If the whole party gets imprisoned the game is still over if you are using The_Bigg's mod.  Personally, I think that all instant kill (or quasi-instant kill) effects should give a saving throw, at least.  There is also no compelling reason that imprisonment would bypass Magic Resistance.  It doesn't in 2e.

I'm sure there's an Imprisonment fix in the Bigg Tweaks that allows it to be cast on your PC.

Hmm good call. Imprisonment is quite irritating. Basically the only way I can defend against it consistently is through Load/Save game...

Imprisonment should have a saving throw (albeit with a hefty penalty).  And it shouldn't bypass magic resistance, either.  This single spell is the reason I never use Fighters, Paladins, Rangers.....pretty much anyone who cant throw up some type of anti-imprisonment protection.  I hate reloading my game when the protagonist gets imprisoned.
